This Privacy Policy applies to MME users, songwriters, rights managers, and other parties ("You," "Your").

1. Personal Data We Collect

Personal Data means any information about you or that can be used to identify you. It includes information that, on its own or combined with other information, identifies you, such as your name, address, date of birth, occupation, phone number, email address, image, bank account and credit card details, gender, or government-issued identifiers, and financial information ("Personal Data"). If We cannot collect your Personal Data, we may not be able to provide our services to you.

We collect and process Personal Data, either as a data controller or processor (as applicable), in the following ways:

1.1.  Data Collected When You Use the Site or Application

  • If You Are a Songwriter

    We collect Personal Data that identifies or can be used to identify, contact, or locate you. Without this data, We cannot provide all the services You request on the Site. The Personal Data We collect includes, but is not limited to:
 
    • Full name
    • Email address
    • Phone number
    • Date of birth
    • Gender
    • Identity Card (KTP) number and a copy of the document
    • Taxpayer Identification Number (NPWP) and a copy of the document
    • Your [transaction] ID
       
  • If You Are a Songwriter Under 18 Years of Age
    We will collect the Identity Card number of Your parent or guardian. You must obtain consent from Your parent or guardian to use MME services.
     
  • If You Are a Rights Manager
    To provide maximum facilitation of our service, in addition to the data listed above, We will require the collection of documentation that explains copyright management and/or related rights, including but not limited to, agreements, powers of attorney from songwriters, or inheritance certificates if the songwriter has passed away.

1.2.  Data Collected from Your Device

Each time you use the Site, we will collect Personal Data in the form of technical data about Your device and usage, such as information about the web pages viewed, session duration, internet device identity (ID), and may include:

  • Log Information: When You use the Site, We will collect information We refer to as "log information." This log information can be collected even if you do not create an account on the Site. This log information may include (but is not limited to) IP address, browser type, operating system, country, pages visited, your mobile operator, device information, and other internet usage-related information. We use this log information to provide you with a better experience when using the Site.
     
  • Cookies and Similar Technologies: Cookies are small data pieces stored on your computer or mobile device to help us track your internet usage. We use cookies in certain email notifications We send after a activities on the Site has been made. In general, We collect personal data directly from data subjects, except in certain cases where We collect Personal Data from third parties ("Third Parties"), such as:

  • Personal Data obtained from user of Your song and/or music copyrights as part of your registration for our business or corporate services, provided with the appropriate consent.
     
  • Personal Data collected in connection with certain financial information and history when You register, access, add, and/or connect (as applicable) financial transaction methods or financial services account on the Site.

In such cases, collection will occur after You acknowledge/guide the relevant third party, or subject to Your explicit consent before such collection.

1.4.  Third-Party Personal Data You Provide to Us

You may provide us with Personal Data related to other third-party individuals. In such cases, You warrant to Us that You have obtained well-documented consent from the relevant third-party individual and hereby consent on behalf of such individual to the collection, use, disclosure, and processing of their Personal Data by Us.

2.1.  Use of Personal Data

We may process and use your Personal Data based on your request or the Terms of Use that you have accepted and agreed to be bound by, including but not limited to the following purposes ("Purposes"):

  • Managing economic rights over the copyright and/or related rights to Your musical compositions, including but not limited to mechanical rights, synchronization rights, and other related rights;

  • Contacting You regarding Your use and access to the Site and managing inquiries and requests You submit through the Site;
  • Measuring and improving Your experience and satisfaction as a user of the Site or Application;
  • Monitoring and analyzing your activity, demographics, behavior, search queries, response times for various services provided on the Site, and any Personal Data you provide to the Site to support and improve performance, user experience, growth, and functionality of the Site. We will anonymize Your Personal Data (or use other methods in accordance with applicable law) before processing it for this purpose;
  • Detecting and preventing money laundering, terrorist financing, fraud, abusive behavior, and harmful or illegal activities, including complying with applicable law, responding to legal requests, and protecting Our rights; 
  • Enforcing the provisions of the MME Terms & Conditions;
  • Resolving disputes, collecting outstanding payments, and addressing issues; and
  • For other purposes that We notify You of when We collect your Personal Data.

2.2.  How We Use Your Personal Data for Marketing Activities

  • Digital marketing, including but not limited to social media, display advertising, Search Engine Optimization (SEO), Search Engine Marketing (SEM), and push notifications, e.g., using open graph techniques, etc.;
  • Conventional marketing purposes, including but not limited to sending emails or communications about MME products or services that may be relevant to You, newsletters, updates, promotional materials, special privileges, greetings during celebrations, surveys, and/or other information that You may find interesting;
  • Registering Your use, access to, and account creation on the websites/applications of Our subsidiaries and/or affiliated companies; and
  • Migrating Your data on Our Site to the websites/applications of Our subsidiaries and/or affiliated companies ("Migration Process"). We may communicate such marketing to You through various means, where applicable (including via SMS, WhatsApp, push notifications, or email).

Please note that You can opt out of receiving marketing materials from us, including the Migration Process, by following the unsubscribe instructions provided in Our marketing materials or by contacting us through the contact details listed below, and We will respect Your wishes. However, please note that the opt-out will take effect within 7 (seven) Business Days after You successfully unsubscribe from the service.

  • If You are a songwriter, the transfer of Your data to Third Party is to assist in facilitating the management of the rights You own, including activities such as copyright registration, licensing, marketing, and engagement with third parties;
     
  • If you are a rights manager, the transfer of your data to Third Party is to assist in facilitating the management of the rights you manage, including activities such as marketing and engagement with third parties;
     
  • To Third Parties related to verification, authentication, risk assessment, fraud prevention, product development, and maintenance, as deemed necessary by Us or other Third Parties before providing You with services, including any activities related to money laundering prevention, terrorist financing, and thorough checks on business and user information;
     
  • To Third Parties, including but not limited to, the Police, Prosecutors, Courts, and competent Government Agencies, in connection with law enforcement efforts within the jurisdiction of the Republic of Indonesia;
     
  • In connection with transaction processes in the form of mergers, consolidations, changes in control or ownership, restructuring, and/or sale of MME business assets, Your Personal Data may be disclosed and transferred as part of such transactions (even if the transaction is ultimately not completed);
     
  • In connection with Our services, We share Personal Data with providers and vendors of website hosting, data analytics, and marketing services;
     
  • If You are a user, to assist in facilitating the verification process with third parties providing services on Our Site.

7. Deletion of Your Personal Data

To the extent permitted by applicable law, you may have the right to request that we delete your Personal Data held by us from our systems. You can submit a deletion request to us using the contact details listed below.

We, without unreasonable delay or within the timeframe as stipulated by applicable law, will reasonably attempt to delete your Personal Data or will reasonably attempt to delete the means or personal identifiers by which the Personal Data can be connected to you as an individual if:

  • The purpose for collecting the Personal Data is no longer served by retaining such Personal Data;
  • We are not permitted or required by applicable law to retain such Personal Data; and/or
  • As required by applicable law, upon Your request to delete Your Personal Data.

Please note that by requesting us to delete your Personal Data, You may no longer a member of MME. We may no longer be able to continue providing some of Our services to You, and You agree that We will not be liable to You for any loss or damage arising from or related to the termination of such services.

8. Retention of Your Personal Data

Unless We delete Your Personal Data from Our systems upon receiving a request from You, Your Personal Data will be retained by us as long as Your account exists, and as long as necessary to provide You with Our services, and/or for Our legitimate business interests, or as long as such retention is required or permitted by applicable law.

We will delete Your Personal Data after 5 (five) years or within a longer period as required by applicable laws and regulations, from the date You terminate/delete Your account.

9. Protection of Your Personal Data

We will protect Your Personal Data by maintaining reasonable security measures, including physical, technical, and organizational measures, to prevent unauthorized access, collection, use, disclosure, copying, modification, deletion, or similar risks. 14. Language and Interpretation

This Privacy Policy is created in Indonesian and English. In the event of any differences between the English version and the Indonesian version, the Indonesian version shall prevail.
